Architectural Standards/Guidelines

I. STANDARDS

1) Preservation of the architectural character of the community is the responsibility of every homeowner. The "Standards" are established not to restrict individual creativity, but to ensure the community's quality and continuous desirability.

2) It is the responsibility of the Association, acting through the "Committee", to control the character of buildings, landscaping and maintenance required to be undertaken by individual homeowners. In the absence of an appointed "Committee", the Board of Directors will act as the ''Committee''.

3) No improvement(s) or alteration(s) to the exterior of a unit may be commenced until plans have been submitted to and approved by the "Committee". However, an improvement may be repainted without "Committee" approval, provided the improvement is repainted the original color which it was last painted (Refer to Article 4.2 of the CC&R's).

4) All plans for improvements or alterations are to be submitted with a $200.00 deposit to Stoney Pointe at Bear Brand Homeowners Association c/o the management company. 

5) Any condition or material not specifically addressed herein or in the CC&R's shall become a matter of judgement on part of the "Committee"

6) Failure to adhere to the "Standards" or the provisions of the CC&R 's regarding architectural review and control will constitute a violation of the Association governing documents and be subject to the provisions of the PROCEDURE AND SCHEDULE OF PENALTIES AND FINES.

II. GUIDELINES

Prior to starting any construction in your backyard, your Association must review and approve the plans before you start. This approval is required so that your neighbor and other members of the Association are not affected by your
construction plans Please submit two sets of building plans 30 days prior to your start up date.

We will need your start date and completion date and plans that include a sketch or final finished plot plan to scale, if possible, showing any slope conditions:

1) Detailed drainage plans. Show drainage in detail Make certain drain runs away from house Watch how the drainage may affect your neighbor's yard

2) Elevations.

3) Patio structure: Show elevations, heights, materials and colors

4) Indicate location, size and type of trees.

5) Planter locations: Planters cannot be raised against any existing walls without first constructing a secondary retaining wall.

6) Types, locations and size of trees

TREE SELECTION: Please keep in mind that the owner assumes all responsibility for any root damage to neighbor's yards or to Association common area. If tree will grow and overhang into neighbor's yards, a signed "Adjacent neighbor Impact" form will be required.

NOTE:
1) Installation of additional rain gutters will be approved on a case-by-case basis Indicate exact location, colors, materials and size of gutters as well as location of downspouts and proposed drainage course. Keep in mind that the approval of all gutter and downspout installations will have to conform to original construction.

2) No removal or planting in flowerbed in front entrance flowerbeds or other common area locations

3) All building materials and/or trash bins delivered for completion of your improvements must be removed from the street within 48 hours after delivery While the material remains in the street, reflectors must be placed on the building materials and/or trash bin for safety.

4) Street cleaning and damage to common area after construction is the responsibility of the homeowner. Please submit the two sets of plans to the management company.

POST TENSION SLAB

By acceptance of a deed to a Unit, each Owner acknowledges and understands that due to expansive soil conditions the concrete slab for his Unit has been reinforced with a grid of steel cables which were installed in the concrete slab and then tightened to create extremely high tension. This type of slab is commonly known as a "Post Tension Slab". Each Owner further acknowledges that cutting into a Post Tension Slab for any reason (such as to install a floor safe, to remodel, etc.) is very hazardous and may result in serious damage to the Unit and/or personal injury.

NO MEMBER OF THE BOARD OF DIRECTORS, THE ARCHITECTURAL COMMITTEE, OR ANY OTHER OFFICER, EMPLOYEE OR AGENT OF THE ASSOCIATION SHALL BE LIABLE TO ANY PARTY (OTHER THAN THE ASSOCIATION OR PARTY CLAIMING IN THE NAME OF THE ASSOCIATION) FOR INJURIES OR DAMAGE RESULTING FROM SUCH PERSON'S ACTS OR OMISSIONS WITHIN WHAT SUCH PERSON REASONABLY BELIEVES TO BE THE SCOPE OF HIS ASSOCIATION DUTIES.
